In Feb 2015, Vietnamese Government issued the Official Decree 15/2015/ND-CP regulating Investment under the form of Public – Private Partnership. The Decree takes effect from April 10, 2015. The new Decree replaced two previous legal documents that regulate the implementation of PPP investment. Those documents include Prime Ministerial Decision 71/2010/QD-TTg guiding the implementation of pilot PPP projects, and Decree 108/2006/ND-CP guiding the implementation of infrastructure projects under BOT, BTO and BT contracts.
It has been said that Decision 71 and Decree 108 had previously confused investors and have yet to follow international standards.
Another regulation that is worth noticing to Foreign investors when they consider investment into PPP projects in Vietnam is Decree 30/2015/ND-CP, which will be in another post.
